These are the terms and conditions when ordering guiding and courses from Uteguiden AS. When you order an activity from us, you approve these. Before ordering, you should therefore familiarize yourself with the terms and conditions. The person making the booking is responsible for providing correct and relevant information for all persons included in the booking.

1. Registration

Registration for courses and guiding at Uteguiden AS is done through the website www.uteguiden.com, by e-mail travel@uteguiden.com or telephone +47 40 55 46 70. We will send you a written confirmation within a couple of days.

2. Payment

The full amount must be paid within 14 days after confirmed booking. The registration is binding from the time when the participant has received a confirmation and paid 100% of the total price. Persons under the age of 18 who participate without an adult must pay the same fee and also need confirmation/approval from a parent or guardian. Upon confirmed booking, these terms and conditions are accepted by the participant(s).

3. Cancellation

  • If cancelled earlier than 15 days before the activity starts, the participant must pay 20% of the total price.
  • If cancelled between 15 and 7 days before the activity starts, the participant must pay 50% of the total price.
  • In case of cancellation during the last 7 days before the activity day, the participant must pay the full total price.
  • Cancellations directly related to official travel restriction related to the Coronavirus, have free cancellation up to 7 days before the trip/course.
  • We recommend all our customers to have a valid travel insurance covering cancellation issues.

Cancellation must be submitted in writing.

4. Amendments

In the event of a change in registration, a change fee of NOK 200 per registered person will apply. However, we cannot guarantee that we will be able to comply with the requested amendment.

5. Changes from the organizer before the activity starts or cancellation of activities

Uteguiden AS reserve the right, at its sole discretion and with the safety of the participant in mind, to change the terms of the agreement to the participant’s disadvantage if needed due to weather conditions or other unforeseen reasons. It the activity is cancelled or interrupted, due to such circumstances beyond our control, Uteguiden AS will not be liable to pay compensation due to non-performance or deficient performance of the activity.

If the minimum number of participants for an activity is not met, Uteguiden AS reserves the right to cancel the activity. The customer will then be offered to participate in the tour/course on a later occasion or be refunded the amount for the tour/course booked with Uteguiden AS.

6. Weather conditions

If the planned activity, at Uteguiden AS and the instructor’s sole discretion, is not safe to carry out due to weather conditions, Uteguiden AS will, if possible within a reasonable timeframe, offer the customer an alternative arrangement. We point out that the customer must pay for a possible intermediate if the price for this arrangement is higher than the first ordered one.

7. Age

Persons under the age of 18 must have a signature on a self-declaration from the responsible parent or guardian to participate in trips/courses. Persons under the age of 16 must basically be accompanied by a responsible person. On selected courses and trips, this can be deviated from by agreement. A number of trips and courses have specific age limits, these are specified in each trip/course description and in the self-declaration. It is up to each individual guest to familiarize themselves with the age limits before booking a trip/course.

8. Arrangement

Uteguiden AS will not pay costs that are caused by the participants’ poor condition or other personal circumstances. The participation fee will not be discounted in connection with an interrupted activity. Uteguiden AS’ instructors have the right to reject participants from the activity if the instructor consider there to be a safety risk and the participant’s health, physical condition and/or equipment prevents the group from carrying out the activity according to the set plan. Uteguiden AS’ instructors have the right to change the activity plan due to incidents that are outside Uteguiden AS’ control.

9. The participant’s responsibility

  • The participant is obliged to follow the instructions given by the instructor or by another person hired by Uteguiden AS. The participant is obliged to respect the rules of order applying to the activity, transport, course facilities etc. and act in a way that other course participants or external persons are not disturbed or suffer discomfort. If the participant, at Uteguiden’s sole discretion, significantly violates this, Uteguiden AS may expel the relevant participant.
  • The participant is liable for and must compensate for the damage he/she causes Uteguiden AS through intent or negligence, for example by not following instructions or regulations. The participant is also liable for and must compensate for the damage that he/she has caused to others that Uteguiden AS has hired.
  • Participants who leave the course after the course has started are obliged to inform Uteguiden AS about this.

10. Included in the price

Each activity or course on this website https://uteguiden.com specifies what is included in the price regarding equipment, transport, and food. This may vary on different products.

11. Insurance

Insurance is not included in the price. The participant is recommended to review his/her insurance to make sure that it covers the current activity or purchase a comprehensive insurance to minimise possible losses due to unforeseeable situations regarding the activity, and for coverage of medical expenses and any repatriation in case of accident/illness. The participant is him- or herself obligated to take out any insurance that he or she deems to be necessary.

12. Claims/complaints/right of withdrawal

Remarks or complaints about the activity must be brought forward to the organizer on site immediately and not at the end of the course. This to give the organizer an opportunity to rectify the matter. It is also a prerequisite for Uteguiden AS to be able to process a possible written complaint. A written complaint must be received by Uteguiden AS no later than two months after the end of the activity. Due to this, no response can be expected until after this time. If you fail to give such notice within the above time limit, you lose the right to make any claim. If the parties reach an agreement or a settlement is agreed upon on site, no further claims can be made.

For exchanges and the right of withdrawal for purchases from our webshop, we refer to the Right of Withdrawal Act (Norwegian). You have the right to withdraw from the agreement (right of withdrawal) by notifying the company before the expiry of the withdrawal period, cf. § 21. All orders made at shop.uteguiden.com are binding, but you can exercise the right of withdrawal which is valid for 14 days after you have received the item. You can make use of the right of withdrawal act by returning the item to us or delivering it to one of our offices in Ålesund or on Stranda.

If you discover an error or a defect on the item you have received from the webshop, you must contact Uteguiden AS within a reasonable time and complain about this. The same applies if you have received something else than what you ordered. Mark the e-mail with “Complaint” or “Received the wrong item” and your phone number, so we can help you quickly. We also refer to the Consumer Purchases Act (Norwegian).

13. Limitation of liability

Uteguiden AS shall not be liable for any loss, damage, accidents, injuries or sickness during your activity. The same applies for any changes in your acticity due to weather, strikes or any other circumstances beyond our control. Under no circumstances will Uteguiden AS be liable for any consequential losses (whether such losses where foreseen, foreseeable, known or otherwise).

14. Dispute resolution

The parties should try to resolve disputes concerning the agreement and interpretation of these terms and conditions through negotiations. Disputes, which cannot be solved without the use of court proceedings, shall be settled by the Norwegian courts according to Norwegian law.
